1. Validity of the conditions of sale
1.1 The terms and conditions of sale apply to the purchase of goods and services between the purchaser (hereinafter the Consumer) and MoonPath OÜ (hereinafter the Online Shop moonpathlight).
1.2 The Terms and Conditions of Sale shall govern the legal relationship between MoonPath OÜ and the individual Consumer.
1.3 In addition to these terms and conditions, legal relations arising from the purchase of products from MoonPath OÜ's online store are governed by the Law of Obligations Act (hereinafter LOA), the Consumer Protection Act (hereinafter CPA) and other legislation in force in the Republic of Estonia.
1.4 MoonPath OÜ reserves the right to make changes to the terms and conditions of sale. These changes will be reflected on the website soojustuspood.ee.
2. Price information
2.1. All products and services offered on the Moonpathlight online store. prices include VAT 24%. The price is subject to a delivery charge.
2.2. The delivery of the goods is carried out by self-delivery, courier service or parcel service. The delivery fee depends on the location of the buyer and the delivery method and quantity of the goods.
2.3 Prices are valid from the time of placing the order until the expiry of the payment term of the placed order (7 days after placing the order).
2.4 If the order is placed before the terms of sale or prices are changed, the legal relationship between the Consumer and MoonPath will be governed by the terms in force at the time the order was placed.
2.5 MoonPath Online Shop reserves the right to make changes to the sales prices. These changes will be reflected on the website moonpathlight.eu .
3. Placing an order
3.1. Add the products you want to your shopping cart.
3.2 To place an order, click on the „Place Order“ link on the top of the shopping cart.
3.3 Next, select whether you wish to place a one-off order as a „guest“ or as a loyal customer (in this case, you will need to log in or register as a loyal customer).
3.4. On the order page, fill in the required fields, select the delivery method and payment method that suits you, and then you will receive an order confirmation, which will allow you to pay according to the payment method you have previously selected by clicking on the „Place order“ link. Before placing your order, you can read the terms and conditions of sale of the Soojustuspood and confirm it by ticking the checkbox in the separate menu. In the order confirmation displayed on the screen, you will find all the details for the euro payment, including all applicable national taxes and surcharges.
3.5. Please fill in the fields on the data and order confirmation page carefully, as the accuracy and correctness of the information provided depends on the prompt and smooth delivery of the products you have purchased and, if necessary, the subsequent resolution of disputes and claims.
3.6. Orders placed through the Online Shop will be processed on working days. (MON-FRI 8.00-17.00). If the order is placed on a Friday after 14.00, the order will be placed the following Monday. Also applies to the „I'll come and pick it up“ delivery method.
4. Entry into force of the sales contract
4.1 With the contract for the sale of goods, MoonPath undertakes to transfer to the Consumer the existing,
the Goods to be manufactured or acquired by MoonPath online shop in the future and to enable the transfer of ownership to the Consumer, the Consumer undertakes to pay MoonPath online shop the amount indicated on the invoice for the Goods and to accept the Goods.
4.2 Orders for which payment has not been received will be cancelled 7 days after the order has been placed.
4.3 The sales contract will enter into force after the payment made by the Consumer has been credited to the bank account of the Online Shop.
5. Delivery to
5.1 After the sales contract enters into force, the MoonPath online shop will bundle the order and hand it over to the company's transport company for delivery (except in the case of the „I will pick it up myself“ delivery term).
5.2 The delivery deadlines indicated on the webshop page are valid from the moment the order amount is credited to the MoonPath webshop bank account.
5.3 In order to ensure prompt delivery, care must be taken to provide correct and valid information when entering delivery details when placing your order.
5.4 MoonPath online store is not responsible for the delay in delivery of goods if the goods have been delivered to the transport company on time, but the delay in delivery is due to circumstances that MoonPath online store could not influence or foresee.
6. Right of return
6.1 After receipt of the order, the Consumer has the right to withdraw from the contract concluded in the e-shop without giving a reason within 14 days. Purchased goods shall not be returnable if the goods have been specially manufactured or purchased for the Customer on the basis of a special order. The returned goods must be in their original packaging and must not have been used.
6.2 In order to return the Goods, you must submit a withdrawal form, the standard form of which can be found on the MoonPath website. The withdrawal form can be sent in free form to the following e-mail address. moonpathou@gmail.com or print out the standard form and attach it to the goods to be returned, at the latest within 14 days of receipt of the goods.
6.3 The consumer must return the goods within 14 days of the submission of the application or provide proof that he/she has handed over the goods to the transport company within the aforementioned period.
6.4 The amount paid by the Customer for the order, including the delivery costs, shall be refunded to the Customer as soon as possible, but not later than 14 days after the submission of the request to cancel the purchase of the goods. In the event of a partial return, the delivery charge shall be refunded in proportion to the number of products returned.
6.5 The costs of returning the goods shall be borne by the Consumer, unless the goods delivered do not correspond to the order.
6.6 The amount of the order paid by the customer will not be refunded until the goods to be returned have arrived at the MoonPath warehouse.
6.7 In the event of deterioration of the condition of the item to be returned, the Consumer shall be liable for the depreciation of the item due to the use of the item only if the Consumer has used the item in a manner other than necessary to ascertain the nature, characteristics and functioning of the item. In order to ascertain the nature, characteristics and functioning of the goods, the consumer should handle and use them only as he would normally be allowed to do in a shop.
7. Unquantifiable force
7.1 MoonPath is not liable for damages caused to the Subscriber or for the delay in delivery of goods, if the damage or delay in delivery of goods is caused by circumstances that MoonPath could not influence or foresee.
8. Processing of personal data
8.1 By entering the data in the MoonPath online shop and with the corresponding confirmation, the Consumer grants the right to collect and process the Consumer's personal data (name, contact telephone number, home address, e-mail address) and to forward personal data to the transport company for the delivery of the goods.
8.2 MoonPath Online Shop has the right to use the Consumer's residential or business address for the purpose of sending advertising and other information to the Consumer.
8.3 The consumer has the right at any time to prohibit the collection and use of his/her personal data, except where this is necessary for the collection of a claim arising from the contract or for the delivery of the goods.
8.4 The use of electronic personal data for the purpose of direct mailing will only take place if the Consumer has given his or her express consent to this on the MoonPath website.
8.5 Encrypted data communication with banks when paying for purchases ensures the security of the Consumer's personal bank details and these are not accessible by Veebipoel.
9. Complaints procedure
9.1 MoonPath is liable for the non-conformity of the goods sold to the Consumer with the terms of the contract or for defects that occur within a period of up to two years from the delivery of the goods to the Consumer. During the first six months of this period from the delivery of the goods to the purchaser, it shall be assumed that the defect already existed at the time of delivery of the goods. It is the responsibility of the Online Shop to rebut this presumption.
9.2 In the event of a defect, the consumer has the right to contact MoonPath online store within two months at the latest, submitting the invoice on the basis of which the purchase was paid for.
9.3 In the event of a defect in the goods, the use of the goods must be discontinued.
9.4 The repair or replacement of defective goods is agreed between MoonPath and the Consumer. The costs of repair shall be borne by the MoonPathlight online shop.
9.5.MoonPath OÜ is not liable for any defects in the product caused by the Consumer as a result of improper storage of the product or use of the product in a manner not intended.
9.6 In case of non-compliance or defects of the product, please send an e-mail to.
moonpathou@gmail.com with the name of the person who placed the order, the contact telephone number, the order number and a precise description of the non-conformity or defect.
9.7. Complaints concerning non-compliance or defects must be lodged within two months of the discovery of the non-compliance or defect.
9.8 All complaints will be investigated and the Consumer will be contacted as soon as possible, but no later than. 14 days within two months of receipt of the complaint.
9.9.The consumer has the right to demand that MoonPath OÜ reduce the purchase price or terminate the contract and claim a refund for the goods if MoonPath OÜ is unable to repair or replace the goods, the repair or replacement of the goods fails, MoonPath OÜ has not remedied the defect within a reasonable time, or the consumer has suffered unreasonable inconvenience.
10. Consumer's right to apply to the Consumer Complaints Committee
10.1 If the Online Shop has refused to resolve the complaint of the Consumer or the Consumer does not agree with the solution offered by the Online Shop and considers that his/her rights have been violated or his/her interests have been harmed, the Consumer may lodge a complaint with the Consumer Disputes Committee via the Consumer Protection Board or with the court.
